LEGAL STATUS OF EDR DATA ACCESS
Canada: No specific laws – considered diagnostic/non-private data, though insurers typically obtain consent.
United States: The 2015 Driver Privacy Act restricts EDR data access, establishing vehicle owner rights. Seventeen states enforce additional privacy laws (AR, CA, CO, CT, DE, ME, MT, NV, NH, NJ, NY, ND, OR, TX, UT, VA, WA) requiring owner consent for EDR downloads, with limited
exceptions.
